It's a bug in the validator.nu software. The W3C version 
http://validator.w3.org gets it right.

In general, "HTML5" (or "the living HTML standard") is a moving target, 
and any validation relative to it is experimental and subject to change 
with no prior or posterior notice, and is not necessarily synchronized 
with other validators or the current state of the draft/spec/standard.
