Short answer: neither is correct or incorrect.
From http://www.w3.org/TR/html-markup/header.html
"The header element typically contains the headings for a section (an
h1-h6 element or hgroup element), along with content such as
introductory material or navigational aids for the section." [*]
You can put a <nav> element in there, if it suits you. Or not. There
isn't really a best practice here.
[*] NB: afaik, <hgroup> has been depracated.
