[whatwg] Doctype, "html" or "HTML"

Hi,

The initial phase[1] section, on A DOCTYPE token marked as being correct, 
says:

>Append a DocumentType node to the Document  node,
>with the name attribute set to the name given in the
>DOCTYPE token (which will be either "html" or "HTML") [...]

...but given the DOCTYPE name state[2], won't the name always be "HTML"?
