If items in a list are to be cited by reference (e.g. "5 b") within or without the text, then the form of that reference is part of the reference not merely styling information. As the spec says:
"The type attribute can be used to specify the kind of marker to use in the list, in the cases where that matters (e.g. because items are to be referened by their number/letter)"
